Should I talk to the other driver’s insurance company?

No. You are not required to give a recorded statement to the other driver’s insurer, and anything you say will be used to reduce your claim. Refer them to us.

What if I was partly at fault?

California uses pure comparative negligence. You can recover even if you were mostly at fault; your recovery is reduced by your percentage of fault.

How long do I have to file?

Generally two years from the date of injury. If a government vehicle or road condition is involved, you may have only six months to file a claim. Call sooner rather than later.

What if the other driver has no insurance?

We check your own policy for uninsured or underinsured motorist coverage, look at household policies, and identify any other liable parties, such as an employer or a vehicle owner.
